Personal data

Personal data notice

This notice is given under section 7 of the Personal Data Protection Act 2010. It says what personal data we collect, why, who sees it, and how you get it back or deleted.

Questions about any of it go to hello@clearhire.asia, and one of the two of us will answer you personally.

What we collect, and where it comes from

  • When you message us on WhatsApp: your phone number, your name if you give it, and whatever you tell us — typically your company, your CIDB grade, how many workers you employ and how many you need.
  • When you email us: your email address and the contents of your message.
  • When you ask for an Open File: the documents and details you choose to send us, which may include company registration papers, project documents and quotes you have been given by other firms.
  • When you use the check on our homepage: nothing. Your four answers stay in your browser. They are only sent anywhere if you press the button that sends them to us.

Why we process it

  • To answer your enquiry and write your report.
  • To follow up once, and then stop.
  • To keep records of advice we have given, so we can stand behind it.
  • To measure which advertisements produce enquiries. We do this with a short reference code attached to the link you clicked, not with your identity.

Who sees it

  • We do. ClearHire is a firm of two and there is no third person reading your file.
  • Our partner licensed agency — but only if you ask us to introduce you, and only your company name and what you need. Never your documents, never a quote you have shown us, and never without your instruction.
  • Our hosting and messaging providers, as a technical consequence of using them: Vercel, which hosts this site and records that a link was clicked, and WhatsApp, when you choose to message us there. Both process data outside Malaysia.
  • Anyone we are legally required to disclose to.

Data leaving Malaysia

  • Our website is hosted by Vercel and our messaging goes through WhatsApp. Both store data on servers outside Malaysia. By contacting us through those channels you accept that transfer. If you would rather not, email or call us instead and we will keep your file offline.

How long we keep it

  • Open Files and the documents supporting them: seven years, because advice about a regulated application should be defensible for as long as it could be questioned.
  • Enquiries that do not become files: twelve months.
  • Advertisement reference codes: twelve months.
  • You can ask us to delete any of it sooner. See below.

Your rights

  • You may ask for a copy of the personal data we hold about you.
  • You may ask us to correct it if it is wrong.
  • You may ask us to delete it, or to stop processing it, and we will unless we are required to keep it.
  • You may withdraw consent at any time. It will not cost you anything and we will not ask why.

Cookies and tracking

  • This site sets no cookies. It runs no analytics. The typefaces are served from this site rather than from a font provider, so nothing is requested from a third party as you read.
  • We do record, in our server logs, that somebody clicked a link to WhatsApp and which advertisement it came from. That record contains a short reference code, the time and the referring page. It does not contain your name.
  • If that changes — and it will, when we start advertising — this page changes first, and the change is logged in our corrections log.

Complaints

  • Complain to us first, by email, and you will get a personal reply from whoever handled your file — not a ticket number.
  • If you are not satisfied, you may complain to the Personal Data Protection Commissioner, Jabatan Perlindungan Data Peribadi Malaysia.
  • We are not licensed by JTKSM, so JTKSM does not supervise our advice the way it supervises a licensed agency. That is a real gap and you should weigh it.

Apa yang kami kumpul

  • Apabila anda menghubungi kami melalui WhatsApp: nombor telefon anda, nama anda jika diberikan, dan maklumat yang anda kongsi — biasanya nama syarikat, gred CIDB, bilangan pekerja sedia ada dan bilangan yang diperlukan.
  • Apabila anda menghantar e-mel: alamat e-mel anda dan kandungan mesej anda.
  • Apabila anda meminta Open File: dokumen dan butiran yang anda pilih untuk hantar kepada kami.
  • Apabila anda menggunakan semakan di laman utama: tiada. Empat jawapan anda kekal dalam pelayar anda melainkan anda menekan butang untuk menghantarnya kepada kami.

Mengapa kami memprosesnya

  • Untuk menjawab pertanyaan anda dan menulis laporan anda.
  • Untuk membuat susulan sekali sahaja, kemudian berhenti.
  • Untuk menyimpan rekod nasihat yang kami berikan.
  • Untuk mengukur iklan mana yang menghasilkan pertanyaan, menggunakan kod rujukan pendek dan bukan identiti anda.

Siapa yang melihatnya

  • Kami berdua sahaja. ClearHire terdiri daripada dua orang.
  • Agensi berlesen rakan kongsi kami — hanya jika anda meminta kami memperkenalkan anda, dan hanya nama syarikat serta keperluan anda. Tidak sekali-kali dokumen anda tanpa arahan anda.
  • Penyedia hosting dan pemesejan kami: Vercel dan WhatsApp. Kedua-duanya memproses data di luar Malaysia.
  • Pihak yang kami dikehendaki oleh undang-undang untuk mendedahkan.

Data keluar dari Malaysia

  • Laman ini dihoskan oleh Vercel dan pemesejan melalui WhatsApp, kedua-duanya di luar Malaysia. Jika anda tidak bersetuju, hubungi kami melalui e-mel atau telefon dan kami akan menyimpan fail anda di luar talian.

Tempoh penyimpanan

  • Open File dan dokumen sokongan: tujuh tahun.
  • Pertanyaan yang tidak menjadi fail: dua belas bulan.
  • Kod rujukan iklan: dua belas bulan.
  • Anda boleh meminta pemadaman lebih awal.

Hak anda

  • Anda boleh meminta salinan data peribadi anda.
  • Anda boleh meminta pembetulan jika ia salah.
  • Anda boleh meminta pemadaman atau menghentikan pemprosesan.
  • Anda boleh menarik balik persetujuan pada bila-bila masa, tanpa kos dan tanpa soalan.

Kuki dan penjejakan

  • Laman ini tidak menetapkan kuki dan tidak menjalankan analitik. Fon dihidangkan dari laman ini sendiri.
  • Kami merekodkan dalam log pelayan bahawa seseorang mengklik pautan ke WhatsApp dan iklan mana ia datang. Rekod itu tidak mengandungi nama anda.
  • Jika ini berubah, halaman ini berubah dahulu.

Aduan

  • Hubungi kami dahulu melalui e-mel dan salah seorang daripada kami berdua akan menjawab sendiri.
  • Jika anda tidak berpuas hati, anda boleh membuat aduan kepada Pesuruhjaya Perlindungan Data Peribadi, Jabatan Perlindungan Data Peribadi Malaysia.
  • Kami tidak dilesenkan oleh JTKSM, jadi JTKSM tidak menyelia nasihat kami sebagaimana ia menyelia agensi berlesen.
